Lawsuit Filed Against Twitter

Apr 16 2015

The lawsuit alleged false impersonation and the improper use of trademarks, which is in violation of Twitter’s terms and conditions

Orlando, FL – The Orlando-based law firm of Forster Boughman & Lefkowitz (www.fbl-law.com) recently filed a lawsuit against Twitter in the Ninth Judicial Circuit Court in Orange County, Florida on behalf of its client and client’s company. The lawsuit was filed in response to Twitter’s failure to remove a fictitious webpage that was set up using the client’s name and likeness without his consent or authorization. Numerous derogatory and damaging comments concerning the client and his company were made on this site.

Forster Boughman & Lefkowitz attorneys devised a successful plan which caused Twitter to remove the fictitious page and led to identifying the true identity of the party responsible for the offending posts. The lawsuit was filed against Twitter, Inc. and several then-unknown defendants, identified as "John Doe" and “Jane Doe." The complaint alleged causes of action for cyberstalking and cyberharassment, unauthorized publication of name and likeness, various trademark violations, and defamation.

In February 2015, in an internal Twitter memo, CEO Dick Costolo said he was 'frankly ashamed' at how poorly Twitter handled trolling and abuse, and admitted Twitter had lost users as a result.
